These terms govern your use of tedxpune.com, the TEDxPune Tribe app, and your attendance at our events. Please read them before you register, submit anything to us, or buy a ticket.

If you attend, you may appear in photographs and recordings that we publish. See section 8

What you send us isn't confidential

Speaker nominations, ideas and feedback are treated as non-confidential unless we agree otherwise in writing. See section 6

Indian law applies

These terms are governed by the laws of India, and disputes go to the courts at Pune. See section 15

This summary is here to help you find things. It is not a substitute for the full terms below, which are what actually apply.

These Terms of Use are an agreement between you (“you”) and TEDxPune (“we”, “us” or “our”). They cover your access to and use of tedxpune.com, the TEDxPune Tribe mobile application, and any other site, application, service or event of ours that links to these terms (together, the “Services”).

How we handle your personal information is set out separately in our Privacy Policy, which forms part of these terms.

Agreement to these terms

In short: By using the Services, you accept these terms. If you do not accept them, please stop using the Services.

By accessing the Services, registering an account, submitting anything to us, purchasing a ticket or attending an event, you confirm that you have read, understood and agreed to be bound by these terms. If you do not agree with any part of them, you are expressly prohibited from using the Services and must discontinue use immediately.

We may update these terms from time to time. The version that applies is the one published on this page at the time you use the Services, and the “Last updated” date above tells you when it changed. It is your responsibility to review these terms periodically. By continuing to use the Services after a change is posted, you accept the revised terms.

The Services are intended for users who are at least 18 years of age. If you are under 18, you may only use the Services with the involvement and consent of a parent or legal guardian, who agrees to be bound by these terms on your behalf.

Our Services

The Services provide information about TEDxPune, our speakers and our events; allow you to register an account, apply for or purchase tickets, nominate speakers, volunteer and subscribe to updates; and give you access to community features in the TEDxPune Tribe app.

The Services are not directed at anyone in any jurisdiction where making them available would breach local law. If you access the Services from outside India, you do so on your own initiative and are responsible for complying with the laws that apply to you.

Intellectual property and the TEDx licence

In short: We own or license the content on the Services. The TED and TEDx marks belong to TED Conferences LLC and we use them under licence.

The TEDx licence

TEDxPune is an independently organised TEDx event, operated under licence from TED Conferences LLC. TED, TEDx and the associated logos are trademarks of TED Conferences LLC and are used under that licence. We are not TED, we do not speak for TED, and nothing on the Services should be read as a statement by TED. Your use of the Services gives you no right to use the TED or TEDx marks for any purpose.

Our content

Unless stated otherwise, we own or hold the necessary licences for the source code, databases, functionality, software, website designs, audio, video, text, photographs and graphics on the Services (the “Content”), as well as the trademarks and logos it contains. The Content is protected by copyright, trademark and other laws of India and by international intellectual property laws.

The Content is provided on an “as is” basis for your personal, non-commercial use. Subject to these terms, you may access the Services and download or print portions of the Content that you have properly obtained access to, solely for your personal, non-commercial reference. Except as expressly permitted, no part of the Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, translated, transmitted, distributed, sold, licensed or otherwise exploited for any commercial purpose without our prior written permission.

Talk recordings

Recordings of talks given at our events are typically published on TED's platforms and on our own channels. Where we publish a talk recording, it is generally made available under a Creative Commons Attribution–NonCommercial–NoDerivatives licence, in line with TED's requirements for TEDx events. The licence terms shown alongside each recording are the ones that apply to it.

Reporting an infringement

If you believe any Content on the Services infringes your intellectual property rights, please write to us at connect@tedxpune.com with enough detail to identify the material and your rights in it, and we will look into it promptly.

Your account and registration

You may need to register to use parts of the Services. When you register or submit information to us, you represent and warrant that:

  • All information you submit is true, accurate, current and complete, and you will keep it up to date.
  • You have the legal capacity to agree to these terms and will comply with them.
  • You are not a minor in the jurisdiction where you live, or you have your parent or guardian's permission and involvement.
  • You will not access the Services through automated or non-human means, whether by bot, script or otherwise.
  • You will not use the Services for any unlawful or unauthorised purpose.

You are responsible for keeping your password confidential and for all activity that happens under your account. Please tell us immediately at connect@tedxpune.com if you believe your account has been used without your permission.

We reserve the right to remove or reclaim a username if we decide, in our sole discretion, that it is inappropriate, obscene, impersonates someone else, or is otherwise objectionable. If you provide information that is untrue, inaccurate, out of date or incomplete, we may suspend or terminate your account and refuse future use of the Services.

Prohibited activities

You may use the Services only for the purposes we make them available for. You may not use them for any commercial purpose other than one we have specifically endorsed or approved. As a user of the Services, you agree not to:

  • Retrieve data or other content from the Services to build or populate a collection, compilation, database or directory without our written permission.
  • Circumvent, disable or otherwise interfere with security-related features of the Services, including those that prevent or restrict the use or copying of Content.
  • Use the Services to advertise or offer to sell goods and services, or to send unsolicited commercial messages.
  • Impersonate another user or person, or use another user's username or password.
  • Upload or transmit any material that acts as a passive or active information collection mechanism, including web bugs, cookies, pixels or similar devices, or any viruses, trojan horses or other malicious code.
  • Use any automated system — including scripts, bots, scrapers, offline readers or data-mining tools — to access, extract or interact with the Services.
  • Interfere with, disrupt or create an undue burden on the Services or the networks and services connected to them.
  • Attempt to gain unauthorised access to the Services, other accounts, or any computer systems or networks connected to the Services.
  • Decipher, decompile, disassemble or reverse-engineer any of the software that makes up part of the Services, except to the extent that applicable law permits it.
  • Harass, abuse, threaten, defame, intimidate or harm another person, including our team, volunteers, speakers and other attendees.
  • Copy, adapt or modify the Services' software, including HTML, JavaScript or other code.
  • Use the Services in a way that is inconsistent with any applicable law or regulation.

Your contributions and submissions

In short: You keep ownership of what you send us, but you give us permission to use it, and we do not treat submissions as confidential.

The Services may invite you to submit content — speaker nominations, applications, proposals, ideas, feedback, comments, suggestions, photographs, videos or other material (“Submissions”). This section applies to everything you send us, however you send it.

What you promise about your Submissions

By making a Submission, you represent and warrant that:

  • You own it or have all necessary rights, licences and permissions to send it to us and to grant us the licence below.
  • It does not infringe anyone's copyright, trademark, privacy, publicity or other rights.
  • It is not false, misleading, defamatory, obscene, harassing, discriminatory, threatening or otherwise unlawful.
  • If it contains anyone else's personal information or likeness, you have their consent to share it with us.

The licence you give us

You retain ownership of your Submissions. By making a Submission, you grant us a worldwide, royalty-free, irrevocable, perpetual, non-exclusive and transferable licence to host, store, use, reproduce, adapt, publish, translate, distribute and display it, in whole or in part, in any media and in connection with the Services and the promotion of TEDxPune. Where reasonably practicable, we will credit you.

Submissions are not confidential

Unless we have agreed otherwise in writing before you send it, we treat every Submission as non-confidential and non-proprietary. We receive a large number of ideas and nominations, and they may resemble things we are already working on or receive from others. We are under no obligation to keep a Submission confidential, to respond to it, to use it, or to pay you for it — and we are free to develop or commission similar things independently.

Moderation

We are not obliged to monitor Submissions, but we may review, edit or remove any Submission at any time, without notice and at our sole discretion, including any we consider to breach these terms or to be harmful to other users.

Tickets, admission and conduct at events

In short: Tickets are issued to you personally. Programmes can change, refunds are limited, and we can refuse or revoke admission.

Registration and tickets

Attendance at a TEDxPune event may be by application, invitation or ticket purchase, as stated for each event. Submitting an application does not guarantee admission. A ticket is confirmed only when we have received full payment and issued a confirmation to you.

Tickets are issued to the named attendee and are personal to you. Unless we say otherwise in writing, they may not be transferred, resold, auctioned or used for any commercial purpose. Any ticket obtained or offered in breach of this may be cancelled without refund. We may ask for photo identification at the venue and may refuse entry if the name does not match the ticket.

Programme changes, cancellation and refunds

Speakers, performers, session order, timings, format and venue are indicative and may change. A change of speaker or programme is not by itself grounds for a refund.

Unless the terms published for a specific event say otherwise, or applicable law requires otherwise, ticket fees are non-refundable. If we cancel an event outright and do not offer a rescheduled date you accept, we will refund the ticket fee. We are not responsible for your travel, accommodation or other incidental costs.

Conduct at our events

TEDxPune events are meant to be welcoming spaces for ideas and disagreement alike. While attending, you agree to:

  • Treat speakers, attendees, volunteers, staff and venue personnel with respect, and refrain from harassment, discrimination, intimidation or abuse of any kind.
  • Follow the instructions of our team and the venue's safety and security requirements.
  • Refrain from bringing prohibited items into the venue, or from unauthorised commercial activity, promotion, soliciting or distribution of materials.
  • Refrain from disrupting sessions, including through unauthorised recording as set out in section 8.

We may refuse admission to, or remove from the venue, anyone who breaches these terms or whose behaviour we reasonably consider unsafe, disruptive or unlawful, without refund and without prejudice to any other rights we have.

Photography, filming and recording

In short: Our events are photographed and filmed. By attending, you agree that you may appear in that material and that we may publish it.

TEDxPune events are photographed, filmed, live-streamed and recorded for archival, editorial, promotional and educational purposes, and talk recordings are shared with TED for publication on its platforms.

By entering an event venue, you acknowledge that you may be photographed, filmed or recorded, and you grant us and our licensees — including TED — the right to capture, use, reproduce, publish and distribute your image, likeness, voice and any statements you make at the event, in any medium, worldwide, without further approval, credit or compensation.

If you would prefer not to appear in our material, please speak to a member of our team at the registration desk on the day and we will do what we reasonably can to accommodate you, including pointing you to seating outside the main camera positions. We cannot guarantee that you will not appear in wide or crowd shots.

You may take personal photographs and short clips for your own non-commercial use. Recording full talks or performances, professional or commercial filming, and the use of tripods, drones or flash photography are not permitted without our prior written consent. Some sessions may be marked as no-recording, and we will tell you when that applies.

The TEDxPune Tribe app

If you use the TEDxPune Tribe application, we grant you a limited, revocable, non-exclusive, non-transferable licence to install and use one copy of the app on a device you own or control, and to access it in accordance with these terms. You may not decompile, reverse-engineer, disassemble or attempt to derive the source code of the app; modify or create derivative works from it; remove or alter any proprietary notices; or use it in a way that breaches applicable law.

If you download the app from a third-party app store, you acknowledge that:

  • The licence above is between you and us, not between you and that app store, and we — not the store — are solely responsible for the app.
  • You must comply with the store's own terms of service.
  • The store has no obligation to provide any maintenance or support for the app.
  • The store is a third-party beneficiary of these terms as they relate to your licence to use the app, and may enforce them.
  • You must comply with any applicable third-party terms — for example, your mobile data plan's terms — when using the app.

The app may request permissions on your device, and may send push notifications. You control both in your device settings; our Privacy Policy explains what we do with the resulting information.

Third-party websites and content

The Services may link to other websites, or contain content, articles, applications, products or services belonging to third parties — including ticketing providers, payment gateways, video platforms and social networks. We do not investigate, monitor or verify third-party content for accuracy or appropriateness, and we are not responsible for it.

If you follow a link away from the Services, these terms no longer govern your activity, and you should read the terms and privacy policy of the site you have moved to. Any purchase you make through a third party is between you and that third party, and we are not responsible for those transactions.

Managing the Services

We reserve the right, but not the obligation, to: monitor the Services for breaches of these terms; take appropriate legal action against anyone who breaches applicable law or these terms; refuse, restrict access to, limit the availability of, or disable any of your Submissions; remove or disable files and content that are excessive in size or otherwise burdensome to our systems; and otherwise manage the Services in a way that protects our rights and property and supports the proper functioning of the Services.

Term and termination

These terms remain in effect while you use the Services. Without limiting anything else in these terms, we may — in our sole discretion and without notice or liability — deny access to and use of the Services to anyone, for any reason, including for breach of any representation, warranty or covenant in these terms or of applicable law. We may terminate your account, delete your Submissions, and prohibit any further use of the Services.

If we terminate or suspend your account, you must not create a new one under your own name, a false name, or the name of any third party, whether acting for yourself or for someone else. We may also pursue appropriate legal remedies, including civil, criminal and injunctive relief.

You may stop using the Services at any time, and may close your account by contacting us as described in our Privacy Policy.

Changes and interruptions

We may change, modify or remove the contents of the Services at any time, for any reason, at our sole discretion, and we are under no obligation to update any information on them.

We cannot guarantee that the Services will be available at all times. We may experience hardware, software or other problems, or need to carry out maintenance, resulting in interruptions, delays or errors. We reserve the right to change, revise, update, suspend, discontinue or otherwise modify the Services at any time, without notice. You agree that we have no liability for any loss, damage or inconvenience caused by your inability to access or use the Services during any downtime or discontinuance. Nothing in these terms obliges us to maintain or support the Services, or to supply any corrections, updates or releases.

Disclaimer and limitation of liability

Disclaimer

The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the Services and your use of them, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We make no warranties about the accuracy or completeness of the Services' content or of any site linked to them, and we assume no liability for errors or inaccuracies of content, personal injury or property damage arising from your access to and use of the Services, unauthorised access to our servers or any personal information stored on them, interruption of transmission, or any bugs, viruses or malicious code transmitted through the Services by a third party.

Views expressed by speakers at our events or in talk recordings are their own. They are not endorsements or statements by TEDxPune or by TED Conferences LLC. Content presented at our events is for general information and discussion; it is not professional, medical, legal or financial advice, and you should not rely on it as such.

Limitation of liability

To the fullest extent permitted by law, in no event will we or our organisers, volunteers, employees, agents or licensors be liable to you for any indirect, consequential, exemplary, incidental, special or punitive damages, including lost profit, lost revenue, loss of data or other losses arising from your use of the Services, even if we have been advised of the possibility of such damages.

Where our liability cannot be excluded, our total liability to you for all claims arising out of or relating to these terms or the Services will not exceed the greater of the amount you paid to us in the six months before the claim arose, or ₹5,000. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence or for fraud.

Indemnification

You agree to defend, indemnify and hold us harmless — including our organisers, volunteers, employees and agents — from and against any loss, damage, liability, claim or demand, including reasonable legal fees, made by a third party because of or arising out of your Submissions, your use of the Services, your breach of these terms, your breach of the rights of a third party, or any harmful act towards another user or attendee. We reserve the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defence of such claims.

Governing law and disputes

These terms and your use of the Services are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. Subject to the paragraph below, the courts at Pune, Maharashtra have exclusive jurisdiction over any dispute arising out of or in connection with these terms.

Before starting formal proceedings, you agree to try to resolve the dispute informally by contacting us at connect@tedxpune.com. We will try to resolve it with you in good faith within 30 days of receiving your notice.

Other terms

These terms, together with our Privacy Policy and any policies or rules we post on the Services, are the entire agreement between you and us. Our failure to exercise or enforce any right under these terms does not waive that right. If any provision is found to be unlawful or unenforceable, it will be severed to the minimum extent necessary and the remaining provisions will continue in full force. Nothing in these terms creates a joint venture, partnership, employment or agency relationship between us. You may not assign your rights under these terms without our written consent; we may assign ours in connection with a transfer of our activities.

Any electronic communication, agreement or record between you and us satisfies any legal requirement that such communication be in writing, and you waive any right requiring a non-electronic signature or the delivery of non-electronic records, to the extent permitted by applicable law.
